Sec.7-323l-23a. Issuance and revocation of certification

  • (a) The commission shall issue certification upon determination that an individual is eligible to be certified.

    (b) The commission may waive the requirement that a candidate for certification be an active member of a fire department pursuant to sections 7-323l-5a to 7-323l-17a, inclusive, of the Regulations of Connecticut State Agencies, for the purpose of personnel recruitment. In such cases, successful completion of the examination process for a level shall entitle the candidate to a letter of certification eligibility. The actual certification shall be issued upon receipt of proof that the individual has become an active member of a fire department.

    (c) The commission may revoke certification for any of the following reasons:

    (1) The certification was issued by administrative error;

    (2) The holder of the certification obtained such certification through fraud or intentional misrepresentation of a material fact;

    (3) The holder of the certification is professionally unfit to perform the duties for which the certification was granted; or

    (4) The holder of the certification is convicted in a court of law of a crime, and prior to revocation of the certification the commission considered (A) the nature of the crime and its relationship to the holder's certification; (B) information pertaining to the degree of rehabilitation of the holder; and (C) the time elapsed since the conviction or release.

    (d) Revocation shall be in accordance with the procedures established by sections 29-2-1 to 29-2-10, inclusive, of the Regulations of Connecticut State Agencies, pursuant to Chapter 54 of the Connecticut General Statutes.

    (e) Prior to consideration of revocation of a certificate, the commission shall provide notice by mail to the candidate of the facts or conduct which warrants the potential revocation and shall give the candidate the opportunity to show compliance with all lawful requirements for the retention of the certification.
